The deal,
in plain English.

1. Who these terms are with

These terms form an agreement between you and [LEGAL ENTITY NAME], registered at [REGISTERED ADDRESS] ("we", "us", "Jourdwee"). They govern your use of the Jourdwee iOS app and the website at [YOUR DOMAIN]. By installing or using the app you agree to them.

2. Apple's Licensed Application EULA also applies

Because you obtained Jourdwee from the App Store, Apple's Licensed Application End User License Agreement ("Apple's EULA") also governs your licence to use the app. Where Apple's EULA and these terms overlap, both apply; where they conflict on a specific point, these terms govern as between you and us, except where the conflict concerns Apple's role (in which case Apple's EULA governs).

Apple is a third-party beneficiary of these terms and may enforce them against you in respect of your use of the app.

3. Your licence to use the app

Subject to these terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Jourdwee on Apple devices that you own or control, in line with the App Store usage rules and Apple's Family Sharing rules where applicable.

4. One-time payment and future updates

Jourdwee is a one-time-payment app. The price you paid via the App Store unlocks:

• All current features at the time of purchase, including iCloud synchronisation between your Apple devices.
• Future updates to this app — bug fixes, improvements, and new features that fit naturally inside Jourdwee — for as long as we continue to maintain it on supported iOS versions.

"Future updates" does not include:

• Substantially different products that we may release as separate apps (for example, a desktop-only or web app sold as its own product).
• Server-side features that require ongoing operating costs we cannot reasonably absorb. If we ever introduce optional server-side functionality, it will be clearly labelled as optional and will not change what you already paid for.
• Support on iOS versions Apple no longer supports for development.

If we ever change the pricing model for new buyers, your existing licence is unaffected.

5. Your content stays yours

Anything you write in Jourdwee — entries, topic names, search terms, attachments — is yours. We claim no ownership and we receive no licence to it.

Because we don't process your content on our servers, we also can't moderate it, recover it, or read it. You are responsible for what you choose to write and store, including making sure you have the right to store any content you bring in (quotations, photos, and the like).

6. iCloud, sync, and data loss

Jourdwee uses Apple's iCloud (CloudKit private database) to sync your entries between your devices when you have iCloud enabled for the app. The reliability and availability of iCloud are governed by Apple, not by us.

We have no copy of your entries. If your iCloud account is closed, suspended, corrupted, or otherwise inaccessible — by you, by Apple, or by anything else — we cannot recover what was stored there. Use the in-app export to keep your own backups in Markdown or plain text.

You can disable iCloud for Jourdwee at any time in iOS Settings; entries will then live only on the device they were created on.

7. Refunds

All payments are processed by Apple via the App Store. Refunds are also handled by Apple — request them at reportaproblem.apple.com or through your Apple Account settings. We do not have the ability to issue refunds directly.

In jurisdictions where consumer-protection law gives you a statutory right of withdrawal or refund (for example, the EU's 14-day right of withdrawal for digital purchases), nothing in these terms limits that right.

8. Acceptable use

You agree not to:

• Reverse-engineer, decompile, or attempt to derive the source code of the app, except to the extent that applicable law expressly permits despite this prohibition.
• Resell, sublicense, rent, or lease the app to third parties.
• Use the app to violate any law, infringe anyone's rights, or distribute material that you do not have the right to store.
• Use the app to facilitate any automated abuse of Apple's services or our systems.

9. Changes to the app

We may update, modify, or discontinue features of the app over time. We will not introduce changes that materially reduce the value of what you paid for without giving you a reasonable way to keep using a previous version (for example, by leaving an older build available where Apple permits).

We may also stop publishing the app on the App Store at any time. If that happens, we will give reasonable notice via the website, the app, or email where we have it.

10. Disclaimer of warranties

The app is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied — including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation. Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the exclusions in this section apply only to the extent allowed.

11. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or in connection with the app or these terms is limited to the amount you paid for the app. We will not be liable for indirect, incidental, special, consequential, or exemplary damages — including lost data, lost time, or lost opportunities — even if we were advised of the possibility.

Nothing in these terms limits liability that cannot be limited under applicable law (for example, liability for fraud or for death and personal injury caused by negligence).

12. Termination

You can stop using the app at any time. We can revoke your licence if you materially breach these terms, including the acceptable-use rules. On termination, you must stop using the app and remove it from your devices. The provisions that by their nature should survive termination (such as content ownership, disclaimers, limitation of liability, and governing law) will survive.

13. Governing law and disputes

These terms are governed by the laws of [GOVERNING JURISDICTION, e.g. Italy / England & Wales / Delaware], without regard to its conflict-of-laws rules. Disputes will be brought in the courts of [COURTS / CITY], except that consumers may bring claims in the courts of their place of residence where local law gives them that right.

14. Changes to these terms

We may update these terms from time to time. If we make material changes, we will update the "last updated" date above and, where the change significantly affects your rights, notify you in the app or by email before the change takes effect. Continuing to use the app after changes take effect means you accept the updated terms.
